1. Description of the service

wanderbe is a travel companion that leverages artificial intelligence to provide text and audio content to Users exploring various destinations. The App offers suggestions, directions, and contextual information based on the User's location and preferences. To use the wanderbe App, you need to download it from your preferred app store and open an account. Once you have installed the App, simply follow the on-screen instructions.

2. License to use

wanderbe ltd grants You a limited, non-exclusive, non-transferable, revocable license to access and use the App and the services provided therein for personal, non-commercial use, in compliance with these Terms and according to Your free or paid Pass. All rights not expressly granted to you are reserved by wanderbe ltd.

3. Use of Geolocation Data

wanderbe's functionality heavily relies on geolocation services to provide real-time, location-specific information and guidance. By using the App, You grant wanderbe ltd the right to use Your location data to offer these personalized services. Please ensure that Your device's location settings are enabled when using wanderbe. By using the App, You acknowledge and agree that Your personal data, including location data, will be processed in accordance with our Privacy Policy, and You accept and consent to our Privacy Policy.

4. Passes and Payments

wanderbe ltd offers various subscription plans ("Pass") that grant Users unlimited access to the App's features for specific durations. Users can choose from the following Passes:

• Freemium plan: each User is assigned 10 free stories per week
• 1-day pass
• 1-month pass
• 1-year pass

Users can purchase these Passes directly through the App using the available payment methods.

Once a Pass is purchased, it will be activated immediately, granting the User unlimited access to the stories offered by the App for the specified duration. All prices are displayed within the App and are inclusive of applicable taxes unless otherwise stated. wanderbe ltd reserves the right to modify the pricing of Passes at any time. However, any price changes will not affect existing Passes.

By purchasing a Pass, You will have access to the App and its features for the duration of the Pass term. Once purchased, the Pass cannot be canceled, and no refunds will be issued for any unused portion of the term (unless specifically stated in the Refund Policy, see below). The Pass will not renew automatically, and You must manually purchase a new Pass upon the expiry of the current term if You wish to continue accessing the App.

5. Disclaimer of Warranty

General Disclaimer

wanderbe is offered "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. wanderbe ltd does not guarantee that the information, content, or materials included on the App will be accurate, reliable, or correct; that the App will be available at any particular time or location, will be uninterrupted, timely, secure or free from errors; that any defects or errors will be corrected; or that the mobile app is free of viruses or other harmful components. Your use of the App is solely at Your own risk. We will not be liable for any loss or damage that may occur as a result of using the wanderbe App.

Use of AI and limitations

wanderbe uses advanced AI technologies, including Large Language Models (LLM), to generate and curate travel content. While we strive for accuracy, the AI may produce information that is not fully reliable or accurate. As such, all information provided by wanderbe should be independently verified by the User, especially in circumstances where inaccuracies could lead to personal risk or harm. wanderbe ltd is not responsible or liable for any content generated by the AI, including but not limited to content that is illegal, incorrect, offensive, or otherwise harmful or misleading. The voices You hear in this application are generated using artificial intelligence (AI) technology. These voices are not real and are created by a machine learning algorithm.

Use at your own risk

wanderbe is intended to enhance Your travel experience, not replace Your judgement or decision-making abilities. The directions and information provided by the App should be used as a guide only. The User is responsible for their safety and must exercise caution and common sense when following any guidance provided by wanderbe.

7. Limitation of Liability

To the fullest extent permitted by law, the total liability of wanderbe ltd, its affiliates, directors, employees, agents, or licensors, for any claims under these Terms, including for any implied warranties, is limited to the amount You paid for the use of the App in the 12 months period immediately preceding the event giving rise to such claim, or GBP 100, whichever amount is greater.

In no event shall wanderbe ltd, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages resulting from or related to (i) Your use or inability to use wanderbe, (ii) any unauthorized access to or use of the App and/or any personal information stored therein; (iii) any interruption of the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of the App; and/or (vi) any other matters relating to the App. This limitation applies regardless of the theory of liability and even if wanderbe ltd has been informed of the possibility of such damages.

8. Term and Termination

These Terms are effective upon Your acceptance and will remain in effect until terminated by either You or wanderbe ltd, as outlined below.

You may terminate these Terms at any time by discontinuing your use of the App and deleting all copies of the App from your devices.

wanderbe may terminate these Terms or suspend Your access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, Your breach of these Terms, or unexpected technical or security issues.

Upon termination of these Terms, Your right to use and access to the App will immediately cease.

9. Service Access and refund policy

We strive to ensure uninterrupted access to our App. However, if You encounter issues that prevent You from accessing the App during your purchased access period, You may be eligible for a refund or extension of access time under the following conditions:

• Reporting: If You experience any access issues, You must report the problem immediately through our support channels.
• Verification: Upon receiving your report, We will investigate the issue to determine the cause and extent of the access problem.
• Resolution: If We confirm that the issue was on our end and prevented You from accessing the App, We will offer one of the following remedies:
• Refund: A full or partial refund of the purchase price.
• Extension: An extension of Your access period equivalent to the time lost due to the access issue.
• Non-qualifying issues: No refund or extension will be provided for issues resulting from Your failure to comply with these Terms, including, but not limited to, using unsupported devices or operating systems, or failure to maintain an active internet connection.
• Third-party policies: Refunds or extensions are also subject to the refund policies of the platform through which the purchase was made (Apple Store). Any additional rights or remedies provided under those policies will be respected.

10. Miscellaneous

Governing law and jurisdiction

These Terms will be governed and interpreted in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved exclusively in the competent courts of England and Wales.

Modifications

wanderbe ltd reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, We will provide a notice prior to any new Terms taking effect.

Entire agreement

These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous agreements of the parties, whether written or oral.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable in any jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect. The invalidity, illegality, or unenforceability of any provision in one jurisdiction shall not affect the validity, legality, or enforceability of such provision in any other jurisdiction.
